The Lord Mayor’s Charitable Trust

 

The proceeds of the auction will be used by the Lord Mayor’s Charitable Trust to support charities that assist people suffering from homelessness, mental illness, drug or alcohol addiction, trauma, abuse or neglect.

For more than 50 years, the Trust’s fundraising efforts have improved the wellbeing of the most marginalised, vulnerable members of the Brisbane community.

Terms & Conditions

The item for sale is the tickets for two (2) adults to:

  • enjoy two (2) ringside seats to the Battle of Brisbane event on Wednesday 13 December 2017 with an exclusive food and beverage package (the “Experience”).
  1. Your participation in this auction constitutes acceptance of:
    1. these terms and conditions;
    2. eBay’s terms and conditions and
    3. the third party provider’s terms and conditions
  2. The Promoter of the Exclusive Battle of Brisbane Absolute Ringside Package auction is the Lord Mayor’s Charitable Trust, (ABN 56 804 674 564) (“the Promoter”).
  3. Bid For Good ABN 96 984 486 617 (“Bid For Good”) is the Promoter?s agent managing the auction on behalf of and at the direction of the Promoter to fundraise. View Bid For Good’s Authorisation to Fundraise.
  4. The auction, a game of skill, is only open to Australian permanent residents aged 18 years and over. The Promoter and Bid for Good may restrict the auction at any time, at their discretion, to prequalified bidders, as per clause 5.
  5. Bidding above $1,000 may be limited to pre-qualified bidders. If pre-qualification is put into place, bidders may be required to make an AU$50 PayPal authorisation deposit to Bid For Good’s PayPal account in order to qualify to bid. The authorisation deposit will be deducted and held by PayPal for the duration of the auction, however, after the close of the auction Bid For Good will void the PayPal authorisation of all non-Winning Bidders (and the deposit will be released) and void the PayPal authorisation of the Winning Bidder following receipt of full cleared payment from the Winning Bidder.
  6. The Promoter may, at any time and in its reasonable discretion, also conduct further screening of bidders, including requesting additional documentation on a bidder’s ability to make payment or a bidder’s location. Only genuine bids and bidders with sufficient funds to purchase the item (at the highest amount that they choose to bid) are allowed.
  7. The Promoter reserves the right to reject a request to bid or to cancel already approved bids in its sole discretion, acting reasonably, where it believes a breach of these Terms and Conditions has occurred. The Promoter’s decision regarding any aspect of this auction is final and no correspondence will be entered into.
  8. To the extent permitted by law, the Promoter shall not be responsible for any bid that is not processed due to technical problems or delays.
  9. By making a bid, the bidder warrants that:
    1. It/he/she has read and understands these terms;
    2. It/he/she has full authority to engage in the transaction;
    3. All information provided to Bid For Good or the Promoter is true and complete;
    4. Their bid is genuine and the bidder has sufficient funds to purchase and make payment for the item at the highest price they bid;
    5. It/he/she did not rely on any representations made by Bid For Good or the Promoter other than as made on this eBay listing.
  10. The auction will commence at 8.00pm (AEDST) on Wednesday 6 December 2017 and conclude at 8.00pm (AEDST) on Monday 11 December 2017. The bidder who places the highest bid as at the end of the auction will be deemed to be the Winning Bidder, subject to verification (“Winning Bidder”). The Winning Bidder must make payment for the Experience by Direct Bank Deposit into the account nominated by the Promoter or PayPal at the completion of the auction. PayPal payments attract a merchant fee from PayPal which will be deducted from the winning bid before proceeds are remitted to the Promoter, however if the Winning Bidder pays by bank transfer then this will avoid any such merchant fees being deducted. Full payment instructions will be provided to the Winning Bidder at the conclusion of the auction. If payment is not made by this time, without prejudice to any of its other accrued or contingent rights and subject to the applicable laws, the Promoter may in its absolute discretion:
    1. cancel any uncompleted contract with the Winning Bidder and re-commence the auction;
    2. cancel any uncompleted contract with the Winning Bidder and enter into discussions with the next highest bidder; or
    3. charge the Winning Bidder for, and the Winning Bidder must indemnify the Promoter from, all costs and expenses (including without limitation all legal costs and expenses) incurred by it resulting from the default or in taking action to enforce compliance with the terms.
  11. Bidders should rely on their own independent financial and taxation advice prior to placing a bid.
  12. The Promoter will issue a tax invoice in the Winning Bidder’s name for the winning bid amount (“Sale Price”).
  13. Following cleared payment the Winning Bidder will receive confirmation from the Promoter with all details including contacts necessary to redeem the Experience including; and the Sale Price will be held on trust until the Winning Bidder receives the details to redeem the Experience.
    All proceeds from the auction of the Experience (excluding any charges payable to PayPal on the Sale Amount) will be paid into an account held by the Promoter to support charities that assist people suffering from homelessness, mental illness, drug or alcohol addiction, trauma, abuse or neglect.
  14. All elements of the Experience are subject to availability with no cash alternative and the Experience is non-refundable and non transferable.
  15. This Experience must be claimed/utilised on 13 December 2017.
  16. Participants cannot change, vary, substitute or extend any element of the Experience (in whole or in part).
  17. The Winning Bidders are responsible for all expenses not stated including, without limitation, transport, transfers, ground transportation, accommodation, insurance, surcharges, meals (other than specified), incidentals, items of a personal nature and all other ancillary costs. Compliance with any health or other government requirements is the responsibility of the Winning Bidders.
  18. The Provider reserves the right to ask the Participant to provide proof of identity and proof of residency at or prior to the time of redemption of the Experience. Identification considered suitable for verification is at the discretion of the Provider.
  19. Participants are subject to the third party provider (Brisbane Convention and Exhibition Centre) policies and as updated from time to time including the following:
    1. Dress code is smart casual. No thongs or singlets will be permitted. This will be strictly monitored.
    2. Brisbane Convention and Exhibition Centre has a legal responsibility to provide corporate hospitality environments where alcohol is served responsibly. It is an offence to sell or supply alcohol to an intoxicated person, allow any person to become intoxicated, or allow an intoxicated person to remain on the premises. Any guests who show signs of intoxication will be refused service and may be removed from the venue. It is an offence to serve alcohol to a minor and any minors within Brisbane Convention and Exhibition Centre licensed areas must be accompanied by a legal guardian. Enjoyment of all patrons at Brisbane Convention and Exhibition Centre is paramount.
    3. Brisbane Convention and Exhibition Centre has a zero tolerance policy around offensive or abusive behaviour and will enforce any unacceptable guest activity by removing them from the venue.
  20. By participating in this auction, the Winning Bidders accept full responsibility for their decision to participate in the Experience and hold the promoter harmless from any loss, injury, damage, cost, liability or expense suffered or incurred by a participant in connection with participating in this auction or the Experience.
  21. No compensation will be payable or alternative item provided if the Winning Bidders are unable to participate in an Experience as stated and provided.
  22. The Experience may not without the prior written consent of the third party supplier be resold at a premium nor used for advertising, promotions, or other commercial purposes (including competitions, trade promotions or hospitality packages) or enhance the demand for other goods or services.
  23. Nothing in these terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, agencies and agents) is not liable under any circumstances whatsoever for any loss, damage, injury or expense whether to people, property or otherwise arising directly or indirectly as a result of the conduct of any third party suppliers, or otherwise as a result of the Winning Bidder (or companion) participating in the Experience, including any loss, damage, injury or expense which is due to any negligence of the Promoter.
  25. If this auction is interfered with in anyway or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the auction, as appropriate.
  26. To the extent permitted by law, Bid For Good is not responsible for any errors or omissions or for any warranties or guarantees either explicit or implied herein including the quality, safety, or legality of any aspect of the Experience listed, the truth or accuracy of the listing or the ability to provide the Experience listed.
  27. The personal information you provide may be collected by and disclosed to the Promoter. The Promoter may use this information to conduct this auction and provide the Winning Bidder with the Experience. The Promoter may also disclose such personal information to third parties, including but not limited to agents, contractors, prize suppliers and service providers. Participation in the auction is conditional on providing the requested personal information. Personal information collected from entrants will not be disclosed to any entity located outside of Australia. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth).
  28. No part of the content of this auction or associated pages (including photos, video, text, design) may be used without the written permission of the appropriate license holders.
