eBay Charity Auction Terms and Conditions

 

  1. Your participation in this auction constitutes acceptance of these terms and conditions and the
    SCG Trust Terms and Conditions attached here.
  2. The item for sale is the SCG Trust Experience at the Sydney Cricket Ground on January 26 2015 for the Australia v India One Day Game ( the “Experience”). The Experience includes:
    1. a private suite for up to 16 people
    2. light dinner and supper
    3. car space for 1 car
    4. 4 programmes
    5. Ian Chappell will visit you in the suite for a drink.
  3. The Promoter’s decision regarding any aspect of this auction is final and no correspondence will be entered into.
  4. The Promoter acting in good faith, reserves the right not to accept bids from any participant.
  5. This auction listing may be restricted to pre-approved bidders only. Bidder Prequalification is a security verification measure given the high profile nature of this auction to protect the charities from non-genuine bidding.
  6. The Promoter reserves the right to reject requests to bid or cancel already approved bids at its sole discretion. The Promoter may also conduct further screening of bidders, including requesting additional documentation on the ability to make payment as well as request a deposit via PayPal or credit card before being allowed to bid/continue bidding, regardless of eBay feedback history.
  7. The Promoter shall not be responsible for any bid not processed due to technical problems or delays.
  8. If the Sale Item becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Sale Item of equal or greater value.
  9. The winning bidder must make payment for the Sale Item by PayPal or Direct Bank Deposit within three (3) working days of the auction.
  10. All elements of the Experience are subject to availability with no cash alternative and the experience is non-refundable.
  11. This Experience must be utilised on January 26, 2015.
  12. Participants cannot change, vary, substitute or extend any element of the Experience (in whole or in part).
  13. Any dietary requirements or allergies should be noted when booking.
  14. The winning bidder will receive confirmation from the Promoter with all details including contacts necessary to redeem the Experience.
  15. No compensation will be payable if the Participant is unable to participate in an experience as stated and provided.
  16. Under normal circumstances this is not a tax deductible donation. The buyer should rely on their own tax advice.
  17. Participants are responsible for all expenses not stated including, without limitation, transport, accommodation, insurances, surcharges, meals (other than specified), incidentals, items of a personal nature and all other ancillary costs.
  18. By participating in the Experience, Participants accept full responsibility for their decision to participate in the Experience and hold the Promoter harmless from any loss, injury, damage, cost, liability or expense suffered or incurred by a participant in connection with participating in the Experience.
  19. Except as required by law, the Promoter (including its respective officers, employees, agencies and agents) is not liable under any circumstances whatsoever for any loss, damage, injury or expense whether to people, property or otherwise arising directly or indirectly as a result of the conduct of any third party suppliers, or otherwise as a result of the winning bidder (or nominee) participating in the Sale Item, including any loss, damage, injury or expense which is due to any negligence of the Promoter.
  20. All proceeds from this auction will be donated to The Australian Association For The United Nations High Commissioner For Refugees
  21. (ABN 35092 843 322) (the “Charity”) to be applied for charitable purposes.
  22. The Charity is a registered charity in the State of NSW and holds a charitable fundraising licence in this State. eBay and PayPal have generously waived all fees and commissions.
  23. Bid For Good (ABN 96984486617) (“Bid For Good”) has been authorised by the Charity to conduct this auction. View a copy of the Charity’s authorisation letter attached here.
  24. Once received, payment for the Sale Item is non-refundable.
  25. The Sale Item is non-redeemable for cash or other goods or services.
  26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
  27. Except where liability cannot be excluded or limited in accordance with the law, the Charity (including its respective officers, employees, agencies and agents) is not liable under any circumstances whatsoever for any loss, damage, injury or expense whether to people, property or otherwise arising directly or indirectly as a result of the conduct of any third party suppliers, or otherwise as a result of the winning bidder (or nominee) participating in the auction or its use of the Sale Item, including any loss, damage, injury or expense which is due to any negligence of the Charity.
  28. Bid For Good is the Charity’s agent managing the auction on behalf of and at the direction of the Charity and as such is not responsible for any errors or omissions or for any warranties or guarantees either explicit or implied herein including the quality, safety, or legality of any aspect of the Sale Item listed, the truth or accuracy of the listing or the ability to provide the Sale Item listed.
  29. No part of the content of this auction or associated pages (including images, video, text, design) may be used without the written permission of the appropriate license holders.
