Auction and Promoter
1.1. By participating in the FUEL TV Australia Auction (Auction) and in consideration for the opportunity to win the Auction, each bidder agrees to be bound by and observe these Terms and Conditions. The placement of a bid in the Auction is deemed acceptance of these Terms and Conditions.
1.2. The promoter of the Auction is FOX SPORTS Australia Pty Limited (ABN 16 065 445 418) of 4 Broadcast Way, Artarmon NSW 2064 (Promoter). Bid For Good (ABN 96 984 486 617) (Bid For Good) is the Promoter’s representative managing the Auction on behalf of the Promoter with the permission of SurfAid International Limited (ABN 31 111 343 287) (SurfAid).
2.1. Participation in the Auction is open to permanent residents of Australia aged 18 years or over.
2.2. The bidding period for the Auction commences on Tuesday, 1 July 2014 and closes on Friday, 4 July 2014 (Bidding Period).
2.3. Each bidder must have a registered eBay account to bid in the Auction.
2.4. The Auction may be restricted to prequalified bidders only. Bidders may be required to make an AU$100 PayPal authorisation deposit to Bid For Good’s PayPal account in order to qualify to bid. Bid For Good will void the PayPal authorisation of all non-winning bidders after the close of the Auction.
2.5. Bid For Good may also conduct further screening of bidders, including requesting additional documentation on bidders’ ability to make payment.
2.6. The Promoter and/or Bid For Good reserves the right to reject a request to bid or to cancel already approved bids in their sole discretion.
3.1. The bidder who bid the highest amount (in Australian dollars) in the Auction at the conclusion of the Bidding Period (the Auction Winner) will receive a Fuel TV Australia experience (the Experience) consisting of:
(a) return economy class airfares for the Auction Winner from the capital city nearest to the Auction Winner’s place of residence to Sydney departing on 7 July 2014 and returning on 8 July 2014;
(b) one night’s accommodation in a four-star hotel in Sydney on 7 July 2014;
(c) return airport/hotel and hotel/FOX SPORTS Australia transfers; and
(d) attending the filming of the FUEL TV ASP Preview Show (Program) at FOX SPORTS Australia on 8 July 2014 and participating in ‘Occy’s Great Shave’.
3.2. The Auction Winner must pay for the Experience by PayPal or Direct Bank Deposit within 24 hours of the conclusion of the Auction.
3.3. The proceeds from this Auction will be donated to SurfAid to be applied for charitable purposes. SurfAid is a registered charity in the State of New South Wales and holds a charitable fundraising licence.
3.4. The Promoter accepts no responsibility for any variation in the value of the Experience. The Experience is not transferable or exchangeable. The Experience is not redeemable for cash and must be taken as offered. If for any reason the Auction Winner does not take an element of the Experience during the stated period and on the conditions stipulated by the Promoter or any third party, that element of the Experience will be forfeited and cash will not be awarded in lieu of that element of the Experience. If the capital city nearest to the Auction Winner’s place of residence is Sydney, the economy class airfares under paragraph 3.1(a) above will not form part of the Experience.
3.5. In the event that any element of the Experience is not available, the Promoter reserves the right to substitute an item of equal or greater value.
3.6. The Auction Winner is responsible for all expenses not specified in these Terms and Conditions, including but not limited to, spending money, any meals not stated above, insurance (including medical, travel and health), transport to and from the Auction Winner’s nearest capital city, any transfers not stated above, items of a personal nature (including but not limited to in-room charges, tips, telephone and laundry) and all other ancillary costs.
3.7. Bidders (including the Auction winner) acknowledge that bidding in the Auction and the taking of the Experience is subject to additional terms and conditions imposed by third party suppliers, including but not limited to, Bid For Good and eBay. Bidders (including the Auction Winner) must become acquainted with any such additional terms and conditions prior to bidding and/or taking the Experience. The Promoter does not accept responsibility and is not liable for any conditions imposed on bidding or the taking of the Experience by any other third party supplier, or the breach of those conditions by any person.
3.8. Travel is subject to fare rules and other conditions of carriage. Tickets will not be exchanged for another destination. The Auction Winner cannot upgrade any travel or accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any flights or with any accommodation in connection with the Experience. Travel must be taken in order to coincide with the Experience in paragraph 8 above. Travel may not be changed by the Auction Winner under any circumstances. If the Auction Winner cannot travel in accordance with these Terms and Conditions and on the flights nominated by the Promoter, the Experience will be forfeited. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice.
3.9. The Auction Winner is responsible for travel documentation and compliance with any health or other government requirements.
3.10. The Auction Winner agrees to provide the Promoter with identification and/or proof of age. In accepting the Experience, the Auction Winner agrees to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter.
Limitation of Liability
4.1. Except for any liability that cannot by law be excluded (including as set out under paragraph 4.3), the Promoter, its related corporations and associated agencies and representative, Bid For Good (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any bidder (including the Auction) in connection with the Auction or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death.
4.2. No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late bids due to technical reasons or any other reason.
4.3. Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia.
4.4. Bid For Good is managing the auction on behalf of and at the direction of the Promoter and as such is not responsible for any errors or omissions or for any warranties or guarantees either explicit or implied herein including the quality, safety, or legality of any aspect of the Experience listed, the truth or accuracy of the listing or the ability to provide the Experience listed.
5.2. Acceptance of the Experience constitutes consent on the Auction Winner’s part to allow the use of the Auction Winner’s name, image, voice and/or likeness by Promoter for production, editorial, advertising, promotional, marketing and/or other purposes (including but not limited to, appearing in an episode of the ASP Preview Show program that will be broadcast on FUEL TV) without further compensation except where prohibited by law.
5.3. No correspondence will be entered into and the Promoter’s decision is final and binding.
5.4. If for any reason the Auction is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of the Auction, the Promoter reserves the right in its sole discretion to cancel, modify, terminate or suspend the Auction.
5.5. The Australian Taxation Office has ruled that donations are not tax-deductible if a person receives goods or services in return for the money given (e.g. the purchase of any items or experiences). For further information, visit the Australian Taxation Office website. Bidders should rely on their own independent financial and taxation advice prior to placing a bid. The Auction Winner is advised that tax implications may arise from the Experience and should seek independent financial and taxation advice prior to their acceptance of the Experience. The Auction Winner is responsible for all taxes (excluding airfare and airport taxes in the prize as set out in paragraph 3.1(a) above and GST) which may be payable as consequence of receiving the Experience.
