  1. The Promoter of the Midwinter Charities auction is The Federal Parliamentary Press Gallery Midwinter Ball Foundation, (ABN 57 699 672 638) ("the Promoter").

Bid For Good ABN 96 984 486 617 ("Bid For Good") is the Promoter’s agent managing the auction on behalf of and at the direction of the Promoter with the express approval of Rotary Australia Overseas Aid Fund  ABN (21 388 376 554), Oz Harvest Limited ABN (33 107 782 196), The Pink Elephants Support Network  ABN (68 613 333 243), a registered charity in the State of New South Wales, Rural Aid Ltd ABN (29 605 783 597), a registered charity in the State of Queensland, Roundabout Canberra Limited ABN (96 624 275 734), Fearless Women Incorporated  ABN (64 668 702 471), a registered charity in the State of Australian Capital Region (the "Charities"). 
  3. The auction, a game of skill, is open to people aged 18 years and over.
  4. The Promoter and Bid for Good may restrict the auction at any time, at their discretion, to prequalified bidders, as per clause 7.
  5. The Promoter may, at any time and in its reasonable discretion, conduct further screening of bidders, including requesting additional documentation on a bidder's ability to make payment or a bidder's location. Only genuine bids and bidders with sufficient funds to purchase the item (at the highest amount that they choose to bid) are allowed.
  6. Bidding above $1,000 may be limited to pre-qualified bidders. If pre-qualification is put into place, Bidders may be required to make an AU$100 Credit Card Holding Deposit to qualify to bid (“Holding Deposit”). The Holding Deposit will be deducted for the duration of the auction. After the close of the auction Bid For Good will refund the Holding Deposit of all non-winning bidders. Bid For Good will refund the Holding Deposit of the Winning Bidder following receipt of full cleared payment from the Winning Bidder.
  7. The Promoter reserves the right to reject a request to bid or to cancel already approved bids in its sole discretion, acting reasonably, where it believes a breach of these Terms and Conditions has occurred.
  8. The Promoter's decision regarding any aspect of this auction is final and no correspondence will be entered into.
  9. By making a bid, You warrant that:
    1. You have read and understands these terms;
    2. You have full authority to engage in the transaction;
    3. All information provided to Bid For Good or the Promoter is true and complete;
    4. Your bid is genuine and You have sufficient funds to purchase and make payment for the item at the highest price they bid;
    5. You did not rely on any representations made by Bid For Good or the Promoter other than as made on this eBay listing. 
  1. The bidder who places the highest bid as at the end of the auction will be deemed to be the Winning Bidder, subject to verification ("Winning Bidder"). 
  2.  If You are the Winning Bidder You must make payment for the Experience within one (1) business day of the completion of the auction. The Winning Bid amount is inclusive of GST (if applicable) ("Sale Price").
  3. This is a charity auction. Proceeds net of payment gateway fees including eBay discounted charity fee of 1.0% plus $0.30  (“Net Proceeds”) will be will be paid into an account held by the Promoter for distribution to the Charities to be applied for charitable purposes. 
  4. If payment is not made within one (1) business day of the completion of the auction, without prejudice to any of its other accrued or contingent rights and subject to the applicable laws, the Promoter may in its absolute discretion:
    1. cancel any uncompleted contract with You and re-commence the auction;
    2. cancel any uncompleted contract with You and enter into discussions with the next highest bidder; or
    3. charge You for, and You must indemnify the Promoter from, all costs and expenses (including without limitation all legal costs and expenses) incurred by it resulting from the default or in taking action to enforce compliance with the terms.
  1. You shall be responsible for paying all Taxes associated with Your purchases. You should rely on Your own independent financial and taxation advice prior to placing a bid.  
  2. If You submit a request the Promoter will issue a tax invoice in the Winning Bidder's name for the Sale Price.
  3. Once Your payment has cleared the Promoter will provide You with all details including contacts necessary to redeem the Experience.
  4. All elements of the Experience are subject to availability with no cash alternative and the Experience is non-refundable and non-transferable.
  5. This Experience must be claimed/utilised on a mutually agreed date within twelve (12) months of the close date of the auction.

Compliance with any health or other government requirements is Your responsibility. 
  9. The Winning Bidders must agree to an Australian Federal Police background check after being confirmed as the successful bidder. If you object to having a background check, please do NOT bid. Identification considered suitable for verification is at the discretion of the Promoter.
  10. You are subject to the Provider's policies as updated from time to time.
  11. By participating in this auction, You accept full responsibility for Your decision to participate in the Experience and hold the Promoter (including their respective officers, employees and agents) harmless from any loss, injury, damage, cost, liability or expense suffered or incurred by a participant in connection with participating in this auction or the Experience.
  12. No compensation will be payable or alternative item provided if You are unable to participate in an Experience as stated and provided.
  13. If this auction is interfered with in anyway or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the auction, as appropriate. 
  14.  Subject to law, if any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter, or where an act, omission, event or circumstance is in the legitimate interests of the Promoter, which prevents the Promoter from providing any or all elements of the Experience, the Promoter will not be liable for any failure to perform or delay in performance and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend (following consultation with the Winning Bidder) any aspect of this Experience.  Without limiting the foregoing, if any element of the Experience cannot go ahead for reasons outside the control of the Promoter, to the maximum extent permitted by law, the Promoter’s (including their respective officers, employees and agents) liability is limited to providing a refund of the amount paid for the Experience.
  15.  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the sales or the supply of the Experience (including but not limited to the Buyer’s or any other person’s acceptance/use of the Experience).

If this auction is interfered with in anyway or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the auction, as appropriate. 
    14.  Subject to law, if any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter, or where an act, omission, event or circumstance is in the legitimate interests of the Promoter, which prevents the Promoter from providing any or all elements of the Experience, the Promoter will not be liable for any failure to perform or delay in performance and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend (following consultation with the Winning Bidder) any aspect of this Experience.  Without limiting the foregoing, if any element of the Experience cannot go ahead for reasons outside the control of the Promoter, to the maximum extent permitted by law, the Promoter’s (including their respective officers, employees and agents) liability is limited to providing a refund of the amount paid for the Experience.
    15.  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the sales or the supply of the Experience (including but not limited to the Buyer’s or any other person’s acceptance/use of the Experience).

Nothing in these terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). To the extent permitted by law, Bid For Good is not responsible for any errors or omissions or for any warranties or guarantees either explicit or implied herein including the quality, safety, or legality of any aspect of the Experience listed, the truth or accuracy of the listing or the ability to provide the Experience listed.

    1. The Promoter of the Midwinter Charities auction is The Federal Parliamentary Press Gallery Midwinter Ball Foundation, (ABN 57 699 672 638) ("the Promoter"). 
    2. Bid For Good ABN 96 984 486 617 ("Bid For Good") is the Promoter’s agent managing the auction on behalf of and at the direction of the Promoter with the express approval of Rotary Australia Overseas Aid Fund  ABN (21 388 376 554), Oz Harvest Limited ABN (33 107 782 196), The Pink Elephants Support Network  ABN (68 613 333 243), a registered charity in the State of New South Wales, Rural Aid Ltd ABN (29 605 783 597), a registered charity in the State of Queensland, Roundabout Canberra Limited ABN (96 624 275 734), Fearless Women Incorporated  ABN (64 668 702 471), a registered charity in the State of Australian Capital Region (the "Charities"). 
    3. The auction, a game of skill, is open to people aged 18 years and over.
    4. The Promoter and Bid for Good may restrict the auction at any time, at their discretion, to prequalified bidders, as per clause 7.
    5. The Promoter may, at any time and in its reasonable discretion, conduct further screening of bidders, including requesting additional documentation on a bidder's ability to make payment or a bidder's location. Only genuine bids and bidders with sufficient funds to purchase the item (at the highest amount that they choose to bid) are allowed.
    6. Bidding above $1,000 may be limited to pre-qualified bidders. If pre-qualification is put into place, Bidders may be required to make an AU$100 Credit Card Holding Deposit to qualify to bid (“Holding Deposit”). The Holding Deposit will be deducted for the duration of the auction. After the close of the auction Bid For Good will refund the Holding Deposit of all non-winning bidders. Bid For Good will refund the Holding Deposit of the Winning Bidder following receipt of full cleared payment from the Winning Bidder.
    7. The Promoter reserves the right to reject a request to bid or to cancel already approved bids in its sole discretion, acting reasonably, where it believes a breach of these Terms and Conditions has occurred.
    8. The Promoter's decision regarding any aspect of this auction is final and no correspondence will be entered into.
    9. By making a bid, You warrant that:
      1. You have read and understands these terms;
      2. You have full authority to engage in the transaction;
      3. All information provided to Bid For Good or the Promoter is true and complete;
      4. Your bid is genuine and You have sufficient funds to purchase and make payment for the item at the highest price they bid;
      5. You did not rely on any representations made by Bid For Good or the Promoter other than as made on this eBay listing. 
    1. The bidder who places the highest bid as at the end of the auction will be deemed to be the Winning Bidder, subject to verification ("Winning Bidder"). 
    2.  If You are the Winning Bidder You must make payment for the Experience within one (1) business day of the completion of the auction. The Winning Bid amount is inclusive of GST (if applicable) ("Sale Price").
    3. This is a charity auction. Proceeds net of payment gateway fees including eBay discounted charity fee of 1.0% plus $0.30  (“Net Proceeds”) will be will be paid into an account held by the Promoter for distribution to the Charities to be applied for charitable purposes. 
    4. If payment is not made within one (1) business day of the completion of the auction, without prejudice to any of its other accrued or contingent rights and subject to the applicable laws, the Promoter may in its absolute discretion:
      1. cancel any uncompleted contract with You and re-commence the auction;
      2. cancel any uncompleted contract with You and enter into discussions with the next highest bidder; or
      3. charge You for, and You must indemnify the Promoter from, all costs and expenses (including without limitation all legal costs and expenses) incurred by it resulting from the default or in taking action to enforce compliance with the terms.
    1. You shall be responsible for paying all Taxes associated with Your purchases. You should rely on Your own independent financial and taxation advice prior to placing a bid.  
    2. If You submit a request the Promoter will issue a tax invoice in the Winning Bidder's name for the Sale Price.
    3. Once Your payment has cleared the Promoter will provide You with all details including contacts necessary to redeem the Experience.
    4. All elements of the Experience are subject to availability with no cash alternative and the Experience is non-refundable and non-transferable.
    5. This Experience must be claimed/utilised on a mutually agreed date within twelve (12) months of the close date of the auction.
    6. Any dietary requirements or allergies should be noted when booking.
    7. You cannot change, vary, substitute or extend any element of the Experience (in whole or in part) subject to agreement with the Promoter.
    8. You are responsible for all expenses not stated including, without limitation, transport, transfers, ground transportation, meals, accommodation, insurance, surcharges, incidentals, items of a personal nature and all other ancillary costs. Compliance with any health or other government requirements is Your responsibility. 
    9. The Winning Bidders must agree to an Australian Federal Police background check after being confirmed as the successful bidder. If you object to having a background check, please do NOT bid. Identification considered suitable for verification is at the discretion of the Promoter.
    10. You are subject to the Provider's policies as updated from time to time.
    11. By participating in this auction, You accept full responsibility for Your decision to participate in the Experience and hold the Promoter (including their respective officers, employees and agents) harmless from any loss, injury, damage, cost, liability or expense suffered or incurred by a participant in connection with participating in this auction or the Experience.
    12. No compensation will be payable or alternative item provided if You are unable to participate in an Experience as stated and provided.
